Victoria University trespasses political dissent

Workers Party Press Release: Workers Party activists Heleyni Pratley and Joel Cosgrove have been trespassed from Victoria University for two years for participating in a student protest against University fee rises of over 90%.

Joel was involved in the throwing of a solitary egg which did not hit anyone.  Heleyni threw nothing and instead stood prominently holding a Workers Party banner calling for ‘free education from kindergarten to PhD’. They and other activists cleaned up the eggshells before leaving.

Let us be very clear. Joel has been trespassed for throwing an egg which he cleaned up afterwards. Heleyni has been trespassed for nothing other than speaking her mind. She is being publicly attacked by the university for exercising her democratic right to protest and express free speech. She is being punished to make an example to anybody else, student or otherwise, who is considering standing up to university injustice.

There is a clear pattern emerging of the University's disregard for any pretense of democracy or free speech on campus. Earlier this year Workers Party activist Ian Anderson was expelled for filming an anti-war protest. A number of other Workers Party activists have already been targeted and attacked by the university.

“In this case as in others it is clear that the University is targeting the people it sees as the leading activists organising against their slash and burn agenda.”  Says Mr. Cosgrove

“The University is attempting to silence debate by expelling, trespassing and intimidating anyone it disagrees with.” he adds

Joel was trespassed over the phone by a man named Darryl, who refused to give his last name or any way of verifying his statement.

Earlier that day Heleyni was met at her door by two men, who demanded to know where Joel was. On being asked to leave, they attempted to physically force their way into the property, against her repeated requests for them to leave, causing her to feel so threatened that she felt she had to slam the door shut and lock it to protect herself from the threat of violence. While this was happening they were yelling through the door in an abusive, aggressive manner that as she was Joel's girlfriend she was also trespassed.  Escaping in a friends car she was shadowed for sometime by the two men who followed her in a large, black SUV.

“I didn't know who they were, or why they were harassing me, I should not be harassed and intimidated for standing up for what I believe in. “Says Ms. Pratley

The Workers Party demands the immediate lifting of all trespasses by Victoria University and a full apology to Heleyni Pratley for the distress caused by their utterly inappropriate actions.

If those people are not even

If those people are not even going to identify themselves as representatives of the university or some other hired thugs then ignoring the trespass notice is an option, legally that is. They need to be representatives of or asked by the uni to do this, which they may be, but you are entitled to proof of this.

I suggest collecting every piece of info you can on these thugs; license plates, ugly-mugshots, vehicle descriptions, location and direction of thier approaches to you, etc..

they may be scary, but there is always more to it than this, they are still just people - people make mistakes and trip up, they have homes too.

The tresspass act

The tresspass act says:

4 Trespass after warning to stay off
  • (1) Where any person is trespassing or has trespassed on any place, an occupier of that place may, at the time of the trespass or within a reasonable time thereafter, warn him to stay off that place.

    (2) Where an occupier of any place has reasonable cause to suspect that any person is likely to trespass on that place, he may warn that person to stay off that place.

    (3) Where any person is convicted of an offence against this Act committed on or in respect of any place, the Court may warn that person to stay off that place.

    (4) Subject to subsection (5) of this section, every person commits an offence against this Act who, being a person who has been warned under this section to stay off any place, wilfully trespasses on that place within 2 years after the giving of the warning.

    (5) It shall be a defence to a charge under subsection (4) of this section if the defendant proves that—

  • (a) The person by whom or on whose behalf the warning concerned was given is no longer an occupier of the place concerned;"

and defines occupier as:

"Occupier, in relation to any place or land, means any person in lawful occupation of that place or land; and includes any employee or other person acting under the authority of any person in lawful occupation of that place or land"

and states that a warning can be given orally, by registered post or by handing over a written notice or placing it near to them.

I don't know if a telephone call be covered by 'orally' wgiven the inability to de certain of the identity of either party. In court you could ask the person who presented the warning to identify who they gave the notice to - which would be an impossibility.

 

I would think a person calling to issue a trespass notice would have to sufficiently identify themselves for the person being warned to accept that they had some authority to issue a notice - otherwise anybody could call anyone and warn them for trespassing and nobody would know whether the notice was real or not.

campus care thugs

The campus security are reknown for not knowing their arse from their elbow - invalid notices were presented to both Nick Kelly & I in 2007, which they in the end had to back down from - they were dated wrongly, and then further invalidated by the security chief signing after Pat Walsh's signature.

Sounds like they haven't improved their understanding of the law since then.

The last time I heard Unions Function Centre staff discussing tresspasses in front of students, there was a distinct bullying tone, and the assumption that new students wouldn't know their rights, or the limits of the staff to restrict campus priviledges.

these guys aren't even at university, can't they just get a fucking job and fight it out with their boss there? oh wait, no one will employ them.

Well, anon, they're not all

Well, anon, they're not all guys, most of them have jobs and are active on them, and all of them have recently exited student politics ( not the same as student activism). 

Their action put student fees on the map, something a thousand crappy closed door 'consultations' will never do.

The real crime is the readiness of Victoria University to severely punish symbolic protest and suppress freedom of expression on the campus.

Universities are mere capitalist instituions with interest in profit, requiring the maintenance of the capitalist order of exploitation and oppression. Expect less?

The 'left' supports VSM

Yes it did promote further discussion of VSM and it was those who wrongly align themselves with the left who officially narked on the protesters that have encouraged that.

Tertiary education seems to be a favourite target of this enlightened government.  I am on the academic staff of the Bay of Plenty Polytechnic and the management are screwing us in the same way.  We have been conducting lightening strikes for the last 3 weeks (suddently there seems to be a lot of industrial action being reported to indymedia).  One piece fo advice I would give is for staff and studetnts to maintian a good relationship with each other.  We are on the same side, even though management try to pit one against the other by moaning about students being disrupted through strikes.  If teachers are on strike students have a perfect right to demand to management that they make up the class they have lost or give out a partial refund. 

Management like to keep staff and students apart and are complaining that I need to maintain a "professional distance" from my students.  In other words they are worried about the students taking my side, and staff taking the students' side.

 

 

The only problem concerning

The only problem concerning the workers party is that Alastair Wreath is a confirmed fuckwit and an embarassing fool.

When he is expelled for some act of gross insensitivity perhaps he will realise that pseudo-maoist attention seeking is perhaps not the best path for him

Although I don't always agree

Although I don't always agree with everything that Heleyni & Joel and other Workers Party members say - I defend your right to say it! Solidarity.

This is an extreme example of what happens in mediocre societies when the image of the university becomes so important that substance, such as liberal rights and truth become next to meaningless. If you looked further into it I think you find that the academics no longer seek the truth and only prepare students for jobs which support the status quo and not new ideas and originality which would take society forward. This is all carefully concealed by hyped up image. See my article on this site on the homepage - The aim of a Great Society would give the elite more soul. It sounds very much what Victoria University needs is 'soul' especially when they react so vehenently to the breaking of an egg butthen medicre societies are a magnet for control freaks, authoritarian personalities and psychopaths. Good luck to the young people who had the courage (and I mean it takes real courage in mediocre societies with all its negative forces) to take this action.

the person that did the phone call was Darryl Stonnel. Managing Director of First contact security. The tresspass order cannot be enforced unless they handed over documentation and served the person to be trespassed, it cannot be done over the phone. The 2 thugs that tried to gain entry were guards from First Contact security or another wing of FCS called Specialised security limited (ssl). Standover tactics are something that Gibson Security used to do, but now that GSL is gone or soon to be out of business (cant belive he is trying to bring it back). as with all things relating to the trespasses act there has to be a paper trail. If there is no official documentation held by either police, the university or the person being served it cant be legal.

Take pics of the thugs or go to some of the bars that First Contact has contracts with. you will find the thugs probably working on the door somewhere in wellington.

Remember to always observe and note down if you think you are being followed. If they do say they work for a security company they have to produce their Security license by law. Any citizen can ask to see a security license and security staff must present it. Also known as a COA (certificate of approval) issued by security governing body, this means that they have been vetted by police and found to be of resonable stanterd to be employed.
